What is GDPR?

In 2016 the European Union (EU) approved a new privacy regulation called the General Data Protection Regulation (GDPR). It applies to all companies that collect the data and information of EU individuals and meet certain territorial requirements. The GDPR legislation is designed to give EU residents more control over the use of their personal data across digital platforms.

EU-U.S. DPF, THE UK EXTENSION, AND THE SWISS-U.S. DPF

Disarea, LLC complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Disarea, LLC has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Disarea, LLC has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. In compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF), Disarea, LLC commits to resolve complaints about our collection or use of your personal information transferred to the U.S. pursuant to the EU-U.S. DPF, the UK extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. EU, UK, and Swiss individuals with inquiries or complaints should first contact Disarea, LLC. 

Disarea, LLC has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbbprograms.org/dpf-complaints for more information and to file a complaint. This service is provided free of charge to you.

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. See https://www.dataprivacyframework.gov/s/article/ANNEX-I-introduction-dpf  

The Federal Trade Commission has jurisdiction over Disarea, LLC’s compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).

Disarea, LLC is obligated to arbitrate claims and follow the terms as set forth in Annex I of the DPF Principles, provided that an individual has invoked binding arbitration by delivering notice to Disarea, LLC and following the procedures and subject to conditions set forth in Annex I of Principles.

Disarea, LLC does not plan to transfer personal information to third parties. If, in the future, such transfer of personal information to a third party acting as an agent on its behalf will occur, Disarea, LLC shall remain liable under the DPF Principles if their agent processes such personal information in a manner inconsistent with the DPF Principles, unless Disarea, LLC proves that it is not responsible for the event giving rise to the damage.

Data Storage

Disarea, LLC uses Liquid Web for hosting our data. Out service are delivered from SSAE-16 (formerly SAS70) Compliant data centers located in the United States.
